NOTICE OF SPECIAL MEETING OF ELECTORS

Wednesday 29 September, commencing at 6pm.
Donnybrook Memorial Hall, Bentley Street, Donnybrook

Sections 5.28 to 5.33 of the Local Government Act 1995 and Regulations 16 to 18 of the Local Government (Administration) Regulations 1996 set out how a Special Meeting of Electors may be called, run and followed-up.  The Presiding Member of the Meeting (the Shire President) has responsibility to set and maintain the procedure for the Meeting.

The information in this notice is provided to inform Electors of the district of the Shire President’s chosen procedure for the Meeting, which is the same procedure as the previous Special Meeting of Electors held in September 2017.

The purpose of the Meeting is to consider questions, statements and motions, on the topics of:

  1. To consider the Shire of Donnybrook Balingup 2021-2022 Budget inclusive but not limited to the proposed 8.6% rate increase.
  2. The Donnybrook and Districts Sporting Recreation and Events Precinct (known as VC Mitchell Community Hub) regarding all aspects of the project and in respect to the required plans as listed - Feasibility Plan, Business Plan and Governance Model.

In order for proper consideration of matters raised by Electors for the Meeting, all questions and motions are required to relate to the stated purpose of the Meeting (as above) and be provided in writing no later than 48 hours prior to the Meeting commencing, as follows:


DBRRA NOTE: Monday the 27th is a Public Holiday, so get your questions or motions in by Friday the 24th, 48 hours for public servants  is usually 2 working days.

  • By email to shire@donnybrook.wa.gov.au; or
  • By post, marked to the attention of the Chief Executive Officer - Special Meeting of Electors; or
  • By hand delivery to the Shire Administration Office, 1 Bentley Streets, Donnybrook, marked to the attention of the Chief Executive Officer - Special Meeting of Electors.

Please note, only those questions or motions to addresses listed above will be accepted. Questions and motions without notice will not be accepted at the Meeting.

The mover of a motion on notice will be allowed up to five minutes and all subsequent speakers (for or against) will be allowed two minutes. The mover of a motion on notice will be allowed a further two minutes to close debate.  Proposed amendments to motions will be the same.

Minutes of the Meeting, including any decisions made by the Electors, are required to be considered by the Council at its next Ordinary Meeting. The Council is not bound by any decisions made at the Special Meeting.

Whilst the start time for the meeting is nominated at 6pm, Electors are encouraged to attend from 5.30pm in order to register for voting purposes. When registering, Electors of the district will be provided with voting cards, with which to cast their vote on any motions presented.  Whilst voting is not compulsory for Electors, a secret ballot is not permitted under the Local Government (Administration) Regulations 1996. Non-Electors of the district are encouraged to attend the Meeting to observe, however, will not be permitted to take part in proceedings.

Shire staff will be in attendance at the Meeting to assist with minute taking and venue arrangements.

I encourage all Electors to attend the Meeting and, as requested, provide questions and motions on notice.

I just have a few questions relating to the Special Electors Meeting.

Before I submit my question/s can you please confirm the following:

  1. How many questions can one Elector submit via email (48 hrs prior) Is there a limit? Unlimited, however, please note that the questions need to relate to the purpose of the meeting and may be combined with other similar questions. Where similar questions are grouped together, we will recognise all people who asked the question.
  2. Is the question just read out by President or does individual who submitted it get to read out question at meeting? They will be read out (to avoid repetition).
  3. If questions of a similar nature are emailed, who gets to choose which question and by whom? The Presiding Member for the meeting (Shire President), in consultation with the CEO.
  4. Are we notified via email if our question will be read out, or just wait and see on the night? We will not be notifying individuals via email prior to the meeting, however, if the question validly relates to the purpose of the meeting, it will be accepted. Similarly to the last Special Meeting of Electors, any questions not accepted will still be recorded in the Agenda and Minutes.
